Terms of Service

These terms cover use of Gyanank. Building questionnaires, collecting responses, the statistics and CSV export are free; the AI features have a monthly allowance, and buying a Study Pass or a subscription raises it. By creating an account or submitting a response to a Gyanank survey, you agree to the terms below.

1. Who can use Gyanank

You must be at least 18 years old to create a researcher account. Gyanank is not directed at children. Survey respondents must be 18 or older, or answer with a parent/guardian assisting them — every respondent form requires this confirmation before submission.

2. Your responsibilities as a researcher

• You're responsible for the content, legality, and ethics of the surveys you create — including obtaining any ethics or review clearance your institution, hospital, organisation or department requires for your study.
• Don't collect more personal data than your study actually needs. Gyanank's AI defaults to anonymous questions; if you add identifying questions (name, email, phone), make sure that's necessary and disclosed to respondents.
• Studies involving children (under 18): if your study targets minors, YOU are responsible for obtaining verifiable parental consent as required by the DPDP Act (§9) and for following your institution's ethics process. Gyanank's built-in "18+ or guardian-assisted" checkbox is a platform baseline, not a substitute for that consent. Never direct a survey link at children for independent completion, and never collect a child's contact details.
• Asking for documents. If your survey asks respondents to attach a document, ask only for what your study genuinely needs and say in the question why you need it. Do not ask for identity documents — a ration card, Aadhaar, PAN, passport, or anything similar — unless your study cannot be done without one and your ethics approval covers it; and never ask a respondent to attach something showing another person's details. You are the person who decides what is collected here, so this is your obligation under the DPDP Act, not ours.
• Invitations. If you invite people to a program, you decide what the form asks and you hold what they give you. Ask only what the program needs, use their details only for that program, and keep the list of registrations to yourself.
• Don't use Gyanank to harass, discriminate against, deceive, or impersonate anyone, or to collect data for any unlawful purpose.

3. What Gyanank must not be used for

Gyanank hosts what you put into it. Under the Information Technology Act and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, we must tell you what may not be hosted here and act when it is. Do not use any part of Gyanank — a form, an invitation, an uploaded image or document, a message to respondents, or an answer — to create, collect, store or share anything that:

• belongs to someone else and you have no right to use;
• is obscene, pornographic, paedophilic, or harmful to a child in any way;
• invades another person's privacy, including their bodily privacy;
• is defamatory, or insults or harasses someone on the basis of gender;
• is racially or ethnically objectionable, or promotes enmity between groups on grounds of religion or caste with the intent to incite violence;
• relates to or encourages money laundering or gambling;
• infringes a patent, trademark, copyright or other proprietary right;
• deceives or misleads anyone about where a message came from, or knowingly spreads misinformation or something patently false;
• impersonates another person;
• threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with other countries, or public order, or incites an offence;
• contains a virus or any other code designed to interrupt, damage or limit a computer or network;
• breaks any law in force.

In particular, never use a Gyanank form to take orders or payments for anything unlawful, to ask for bank, card, UPI, OTP or password details, or to look like a bank, a government office or any organisation you are not.

If we learn that a form, an invitation or an account breaks these rules — from a report, a court order or a notice from a government agency — we may take the form offline and suspend the account at once, without notice. Content we take down, and the account details behind it, may be kept for up to 180 days for investigation, as those Rules require, even if you delete them. Anyone can report a form from the link on every respondent page or from Help & support.

4. AI-generated content

Gyanank's AI drafts questionnaires, suggests which statistical test fits a question you ask, and writes plain-English explanations of results. Review AI-drafted questions and consent text before publishing a survey — you're responsible for what you ultimately publish. The underlying numbers (means, p-values, correlations, and similar) are always computed deterministically by standard statistics libraries, not generated by the AI, but the AI's choice of test and its written explanation should still be checked against your own understanding of the analysis, especially for anything you intend to publish, submit or act on.

5. Your data, and ours

You own the surveys you create and the responses collected through them. We process that data as instructed by you, to operate the service — see our Privacy Policy for details. You can export or delete your data at any time from your dashboard.

6. Paying for Gyanank

Payments are taken by Razorpay into the account of Gyanank Technologies Private Limited, which is the name on your bank or UPI statement and on your invoice. We never see or store your card or UPI details; we record only the payment identifier, amount, currency and status, so that the purchase can be reconciled and so your account gets what you paid for. Prices are shown on the Pricing page and are exclusive of any applicable taxes. Every payment has an invoice you can download from the Purchases section of your account page.

• A Study Pass is a single payment covering one survey for twelve months. It is attached to that survey when you buy it and cannot be moved to another.
• A subscription renews each month until you stop it. Stop recurring payment on your account page cancels the autopay mandate, so nothing more is charged, and Pro stays on to the end of the period already paid for. It does not refund that period.
• Your collected data is never held behind a payment. If a pass expires or a subscription lapses, every running survey keeps collecting, and you keep full access to your responses, the statistics and CSV export. Only the AI features fall back to the free allowance.
• No refunds as of right. A Study Pass and a subscription charge are not refundable; the remedy for a subscription is to stop it, which stops future charges. You may still ask: raise a support ticket from your account page with the payment id and the reason, and we decide each request on its merits. A duplicate charge, where Razorpay took the same payment twice, is always returned to the instrument that paid: write to admin@gyanank.com with both payment ids within 7 days.
• Academic pricing is the same product at a lower price, offered on the strength of the academic email address your account has verified or the student status you have shown. Buying at the academic price with an address or document you are not entitled to use is a breach of these terms.

7. Availability

Gyanank is offered "as is". We aim for reliable uptime but don't guarantee uninterrupted availability, and features may change as the product develops. Deploys are brief but the site can be unreachable for a minute or two while a new version starts; a survey link is unaffected once it is back.

8. Limitation of liability

To the extent permitted by law, Gyanank Technologies Private Limited isn't liable for indirect or consequential losses arising from use of Gyanank. Nothing in these terms limits liability where the law doesn't allow it to be limited.

9. Ending your account

You may delete your account at any time; this removes your surveys and their responses at once. Your sign-up details — name, email address, and when the account was opened and closed — are kept for 180 days afterwards, as the Information Technology Rules require, and then erased. We remind every account holder of these rules by email at least once a year. We may suspend accounts that violate these terms, particularly around unlawful data collection or abuse of the respondent-facing forms.

10. Governing law

These terms are governed by the laws of India. Disputes are subject to the jurisdiction of the courts where Gyanank Technologies Private Limited is registered.
